Terms and Conditions

The webshop sells wholesale bales (wholesale units) of used clothing. The buyer acknowledges that the products are not new. A consumer, according to Section 8:1 (1) 3 of the Civil Code, is a natural person acting outside their trade, independent profession, or business activity. Please note that from March 1, 2026, sole proprietors may also qualify as consumers if the purchase does not fall within their professional activity. In other cases, the legal relationship is B2B.

Delivery is performed by Magyar Posta Zrt. (MPL) in accordance with Section 3/A of Government Decree 335/2012 (XII. 4.), or by Sameday courier service. Personal collection: 3170 Szécsény, Kossuth út 17. The shipping fee depends on the weight of the product (estimated fee: 1,990 - 9,900 HUF/bale), which the Service Provider states itemized on the Checkout page before finalizing the order. The cost of return in case of withdrawal is borne by the consumer, the amount of which is equal to the delivery fee.

Consumers are entitled to a 14-day right of withdrawal without justification under Government Decree 45/2014 (II. 26.). The deadline is calculated from the receipt (physical possession) of the product. The consumer may indicate their intention to withdraw by an unambiguous statement or by using the model form found in these GTC. In case of withdrawal, the consumer is obliged to return the product within 14 days from the communication of withdrawal (Section 25 of Gov. Decree 45/2014). The cost of return is borne by the consumer.

In the case of second-hand clothing, minor defects (approx. 1-2% reject rate) may occur, which the buyer accepts in knowledge of the price. The Service Provider guarantees that the bales contain the selection category according to the description. Consumer rights are governed by the Civil Code, Gov. Decree 45/2014 and IM Decree 1/2024 (II. 1.).

The contract is concluded electronically. The Service Provider sends a confirmation on a durable medium (email) immediately (Section 6/A of E-commerce Act), but no later than 48 hours after receipt of the order. This email contains the ordered items and the basic information elements prescribed by law. In the absence of this, the buyer is exempt from the obligation of the offer.

The legal relationship of the parties is governed by Hungarian law. In case of a consumer dispute, under Section 26 of the Civil Procedure Act (Pp.), the buyer is entitled to turn to the court according to their domicile or place of residence. For non-consumer (B2B) disputes, the parties stipulate the exclusive jurisdiction of the court according to the seat of the Service Provider.

You can make your complaint via email (info@extrahasznaltruha.hu) or orally. Your oral complaint will be examined immediately, and a log will be taken, which we provide with a unique identifier, and a copy will be sent to the consumer (Section 17/A of Consumer Protection Act). We will respond to your written complaint on its merits within 30 days.

In case of a consumer dispute, the EU's online dispute resolution platform can be used: https://ec.europa.eu/consumers/odr. This platform helps in reaching an out-of-court agreement.

The Service Provider is not responsible for performance if an external, unavoidable obstacle arises (natural disaster, war, pandemic) that makes performance according to the contract impossible.

Unjustified refusal to accept the package constitutes a breach of contract. This is an exception if the consumer exercises their right of withdrawal regularly. In case of unjustified refusal, the Service Provider is entitled to claim compensation for its actual damages (shipping and return costs).

In case of regular withdrawal, the Service Provider refunds the purchase price and the standard shipping fee (Section 28 of Gov. Decree 45/2014). We do NOT deduct ANY administration or bank costs from the consumer upon refund. Deadline for refund: 14 days from withdrawal (maintaining the right of retention).

The Service Provider may record the packaging and measurement to avoid disputed cases. Detailed information on data processing is provided in the Privacy Policy.

In the case of sealed hygiene products (e.g., underwear), the right of withdrawal cannot be exercised after unsealing following delivery (Section 29 (e) of Gov. Decree 45/2014). Opening and using the bales may also limit the possibility of returning in original condition.

Our prices are in Hungarian Forints. The indicated prices, based on Section 11 (c) of Gov. Decree 45/2014, in all cases include VAT for consumers (gross prices).

The consumer is entitled to implied warranty (Section 6:159 of Civil Code): repair, replacement, price reduction, or withdrawal can be requested. In case of product warranty, you can turn directly to the manufacturer. In case of a consumer dispute, you may turn to the Conciliation Board operated by the Borsod-Abaúj-Zemplén County Chamber of Commerce and Industry – which as of January 1, 2024, is the competent body for Nógrád County (3525 Miskolc, Szentpáli u. 1.; mailing address: 3501 Miskolc, Pf. 376.; tel: +36 46 501-091 (new cases), +36 46 501-871 (ongoing cases); bekeltetes@bokik.hu; www.bekeltetes.borsodmegye.hu), as well as the Consumer Protection Department of the Nógrád County Government Office (Gov. Decree 45/2014 Section 11 (w)).

The buyer can choose: (1) Advance transfer to the Service Provider's bank account; (2) Cash on delivery at the courier; (3) Secure online credit card payment through the Stripe system (Section 11 (1) g) of Gov. Decree 45/2014).

The Service Provider reserves the right to modify the GTC. The modification does not affect contracts already concluded. Previous GTC versions are archived and made available to the buyer upon request.
